Given the situation any how. Though it may not be the good side and defiantly not the right thing to do; if you look at it from Gina's point of view, for her plan to work she needed Kathryn dead. That was her intention, but Gold did not kill her and it put her in a difficult position. In her case intention was everything.

I agree with Regina. For instance, if you kill someone on accident you get a lighter sentance than if you kill someone with malicious intent. Same outcome, different intent.

Normally I would agree with Regina.

But when you make a deal with Rumple, you have to say exactly what you want to happen. Regina should know that. She said something tragic should happen to Kathryn, and though she meant for her to be killed, she didn't say it.
When it comes to Rumple, you have to be specific and exact. If you aren't, then he'll go at it the way that benefits him most. He'll still go through with the deal and make it happen, just not necessarily the way you wanted him to.

Intent IS meaningless
It's the outcome that matters.
And Rumple's intent is never clear.
